Kesenjangan Norma dan Realitas: Implementasi UU TPKS dalam Layanan Kesehatan bagi Korban Kekerasan Seksual di Sumba Timur
Abstract
Penelitian ini berfokus pada integrasi kelembagaan, tenaga medis, dan fasilitas pelayanan kesehatan (Fasyankes) yang mampu mewujudkan pemenuhan hak-hak dasar korban kekerasan seksual sesuai amanat undang-undang. Sepanjang tahun 2025, kasus kekerasan terhadap perempuan tercatat sebanyak 376.529 atau mengalami peningkatan 14,07%. Data ini mengalami kenaikan dari tahun sebelumnya, korbannya dari kelompok remaja. Permasalahan yang diteliti adalah mencari apa hambatan sistemik yang menghambat implementasi kebijakan tersebut, baik dari sisi keterbatasan infrastruktur kesehatan maupun kompleksitas UU No. 12 Tahun 2022 di Sumba Timur. Penelitian hukum di Sumba Timur menggunakan metode penelitian hukum sosiologis (empiris) untuk melihat bagaimana hukum bekerja di masyarakat setempat. Memilih data primer melalui wawancara dan FGD, melibatkan tokoh organisasi perempuan, tokoh adat, tokoh agama, pemerintahan dan aparat hukum. Disimpulkan ada gap antara idealisme perlindungan hukum nasional dengan realitas kapasitas layanan kesehatan di daerah, sehingga perlu dirumuskan model sinergi yang lebih adaptif terhadap tantangan geografis dan sosiokultural di Sumba Timur.
Abstract: This study focuses on the integration of institutions, medical personnel, and health care facilities capable of ensuring that the basic rights of victims of sexual violence are fulfilled in accordance with the law. Throughout 2025, 376,529 cases of violence against women were recorded, representing a 14.07% increase. This figure represents an increase from the previous year, with victims primarily from the adolescent demographic. The research aims to identify systemic barriers hindering the implementation of these policies, whether due to limitations in healthcare infrastructure or the complexity of Law No. 12 of 2022 in East Sumba. The legal research in East Sumba employs a sociological (empirical) legal research method to examine how the law functions within the local community. Primary data was collected through interviews and focus group discussions (FGDs), involving representatives from women’s organizations, traditional leaders, religious leaders, government officials, and law enforcement. A gap was identified between the ideal of national legal protection and the reality of healthcare service capacity in the region, necessitating the formulation of a more adaptive synergy model to address the geographical and sociocultural challenges in East SumbaKeywords
