Informed consent Sebagai Pelindungan Hukum Dokter Dalam Pelayanan Estetika di Klinik Pratama
Abstract
Di era globalisasi, pelayanan estetika telah menjadi kebutuhan penting bagi individu yang menginginkan kulit yang sehat. Dokter yang memberikan layanan memiliki hak dan kewajiban, salah satunya adalah kewajiban memperoleh informed consent. Proses informed consent penting bagi dokter di klinik pratama estetika, karena juga memberikan pelindungan hukum bagi dokter. Penelitian membahas tiga masalah utama yakni pengaturan informed consent dalam pelayanan estetika di klinik pratama, pelindungan hukum bagi dokter dalam pelaksanaan informed consent di klinik pratama, dan faktor-faktor yang mempengaruhi pelindungan hukum bagi dokter dalam pelaksanaan informed consent di klinik pratama. Menggunakan metode penelitian yuridis empiris, analisis ini menghubungkan teori-teori relevan, peraturan perundangan, jurnal, dan artikel dikaitkan dengan permasalahan dalam penelitian. Hasil penelitian menunjukkan pengaturan informed consent di klinik pratama sesuai dengan Undang – Undang Nomor 17 Tahun 2023 tentang Kesehatan, Peraturan Pemerintah Nomor 28 Tahun 2024 Tentang Peraturan Pelaksanaan Undang - Undang Nomor 17 Tahun 2023 Tentang Kesehatan dan Peraturan Menteri Kesehatan Nomor 290 Tahun 2008 tentang Persetujuan Tindakan Kedokteran. Pelindungan hukum dokter melibatkan dokter, pasien, klinik pratama, Konsil Kesehatan Indonesia, Majelis Disiplin Profesi dan Pemerintah, dengan menggunakan mekanisme penyelesaian sengketa di luar pengadilan melalui Majelis Disiplin Profesi. Pelindungan dapat bersifat preventif atau represif, dipengaruhi oleh faktor yuridis, teknis, dan sosial.
Abstract: In the era of globalization, aesthetic services have become an important need for individuals who want healthy skin. Doctors who provide services have rights and obligations, one of which is the obligation to obtain informed consent. The informed consent process is important for doctors in aesthetic primary clinics, because it also provides legal protection for doctors. The study discusses three main issues, namely the regulation of informed consent in aesthetic services in primary clinics, legal protection for doctors in implementing informed consent in primary clinics, and factors that influence legal protection for doctors in implementing informed consent in primary clinics. Using empirical legal research methods, this analysis connects relevant theories, laws and regulations, journals, and articles related to the problems in the study. The results of the study show that the regulation of informed consent in primary clinics is in accordance with Law Number 17 of 2023 concerning Health, Government Regulation Number 28 of 2024 concerning Implementing Regulations of Law Number 17 of 2023 concerning Health and Regulation of the Minister of Health Number 290 of 2008 concerning Approval of Medical Actions. Legal protection for doctors involves doctors, patients, primary clinics, the Indonesian Health Council, the Professional Disciplinary Council and the Government, using a dispute resolution mechanism outside the court through the Professional Disciplinary Council. Protection can be preventive or repressive, influenced by legal, technical and social factors.Keywords
