PROBLEM YURIDIS PENGECUALIAN INFORMED CONSENT DALAM TINDAKAN MEDIK UNTUK MELAKSANAKAN PROGRAM PEMERINTAH

Abstract


In principle, informed consent is bqSed on patients rights are human
rights. Under no treatment should be approved before the implementation of
medical action. Informed consent is a logical consequence as a result of the
contractual relationship between health care providers and health
care receivers. The legislation regarding informed consent is
based on Health Act and Medical P~actice Act. Nevertheless the spirit of
tnformed consent regulation is a human right, as defined in Human Rights
Act. Informed consent form setting is initially set in the Health Minister
Regulation No. 585 of 1989 on Approval of Medical Action as amended by
Health Minister Regulation No. 290 of 2008 regarding Medical
Action Approval.
Although the U',e of the term is essentially unchanged,
however changes to the terms of the formulation is an exception Exclusion
of medical measures in the implementation of action medical preferred
for life-saving benefit of patients. Setting exceptions in special treatment
as provisions on the implementation of government programs for medical
action for many people without establishing criteria for specificity, then
the juridical implications, in violation of the right of self-determination,
violation of the principles of prudence and even neglect the principle
of legal accountability.
The principle of prevention of possible risks arising also be met
