TINJAUAN TERHADAP KUALITAS INFORMED CONSENT PADA RENCANA TINDAKAN KEDOKTERAN BERDASARKAN PEMENUHAN HAK PASIEN ATAS INFORMASI YANG LENGKAP SEBAGAI ALAT BUKTI TULISAN

Abstract

This study aims to describe the implementation of informed consent,
quality of informed consent on the fulfillment of patients' rights to information and
evidentiary strength of the informed consent on patient radiology examinations
with contrast media in Radiology Departement of Sultan Agung Islamic Hospital in
Semarang.
The Method approach of this research is normative-empirical (applied)
with descriptive qualitative specifications. The subject of this research is patient,
radiologist, radiographer and head of radiology department, and the object is the
informed consent document of radiological examination with contrast media in
January to March 2010. The study used primary datafrom the study of document,
observation and interview, and secondary data from literature studies of primary,
secondary and tertiary legal materials. Data were collected by using the following
methods: observation, document study and interview. Data were analyzed
qualitatively.
The result of this study was that information/explanation is not given
. completely according to minimal stand art, so doesn't fulfill patients' rights of
information. Informed consent form used was appropriate according to K.K.I
guidelines although there are some items that should be added such as medical
record number, age, marital status, sex, and a statement from explanatory. Most of
the filling informed consent is incomplete, so it doesn't match with
agreement/consent as provided in Article 1320 Kl1HPerdata. Approval isn't given
by the entitled person so it is likely be denied The information/explanation in the
informed consent form and medical record is incomplete, unrecorded and
undocumented It can be concluded thaI this informed consent doesn't have formal
and material evidentiary strength.
